Terms of Service

Effective date: May 14, 2026

Welcome to Got It Tap. These Terms of Service (“Terms”) are a legal agreement between you and Got It Tap, operated by Smart Scale Consulting, located in Texas, USA (“Got It Tap,” “we,” “us,” “our”). By creating an account, purchasing a card or subscription, or using our service in any way, you agree to these Terms. If you do not agree, do not use the service.

1. The Service

Got It Tap provides NFC-enabled physical products (cards and wristbands), a hosted digital profile page for each product, and related online services that let you publish links, contact information, and payment handles for others to access by tapping your card or visiting your profile URL.

2. Eligibility and Accounts

  • You must be at least 13 years old to create an account.
  • You must provide accurate and current information when you register and keep it updated.
  • You are responsible for all activity on your account and for keeping your sign-in credentials secure.
  • One account per person. You may not impersonate another person or business.

3. Orders, Shipping, and Refunds

  • Pricing for cards, wristbands, and subscriptions is shown at checkout. Prices may change at any time.
  • Orders ship from the United States. Delivery times are estimates and not guaranteed.
  • Refunds: physical products that arrive damaged or defective may be returned for a full refund within 14 days of delivery. We do not refund opened or used products outside of that window.
  • Subscriptions: you may cancel a paid subscription at any time. Cancellation takes effect at the end of the current billing period. We do not refund partial months.

4. Acceptable Use

You agree not to use Got It Tap to:

  • Publish content that is unlawful, defamatory, threatening, harassing, hateful, or that infringes anyone’s rights.
  • Publish sexually explicit, violent, or abusive content, or content that exploits minors.
  • Misrepresent your identity or impersonate any other person or business.
  • Promote scams, fraud, malware, phishing, or counterfeit goods.
  • Send spam, run a botnet, scrape the service in volume, or attempt to disrupt or compromise our infrastructure.
  • Reverse engineer, decompile, or attempt to extract source code from the service.
  • Resell, sublicense, or whitelabel the service without a written reseller agreement with us.

We may, at our sole discretion and without prior notice, suspend or terminate any account that violates these rules.

5. Your Content

You retain full ownership of the content you publish to your profile (your photos, bios, links, and other materials). You grant us a worldwide, royalty-free, non-exclusive license to host, display, and serve that content for the sole purpose of operating the service for you. We do not claim any other rights in your content. We will not sell, resell, or use your content to promote any third party.

6. Our Content

Got It Tap, the Got It Tap logo, the website code, the public profile templates, and all related design and software are owned by Got It Tap or its licensors and are protected by intellectual property laws. Your account does not give you any right to copy, modify, distribute, or create derivative works of those materials.

7. Third-Party Services

Got It Tap relies on third-party services to operate, including Stripe (payments), Google (optional OAuth sign-in), SmartScale CRM (order fulfillment), as well as our database and authentication provider, our hosting provider, and our transactional email provider. Your use of those services through Got It Tap is also subject to their respective terms and privacy policies. We are not responsible for the acts or omissions of those providers.

8. Privacy

Our handling of your information is described in our Privacy Policy, which is incorporated into these Terms by reference.

9. Termination

  • You may close your account at any time by emailing support@gotittap.com or using the account-deletion option in your dashboard.
  • We may suspend or terminate your account if you violate these Terms, fail to pay any amounts owed, or use the service in a manner that threatens the integrity of the service or other users.
  • On termination, your profile pages will become inactive and we will delete your data per our retention policy in the Privacy Policy.

10. Disclaimers

The service is provided “as is” and “as available.” To the fullest extent permitted by law, Got It Tap disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the service will be uninterrupted, error-free, secure, or that any data will be preserved indefinitely.

11. Limitation of Liability

To the maximum extent permitted by law, Got It Tap and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the service. Our total aggregate liability for any claim arising from or related to these Terms or the service is limited to the greater of (a) the total amount you paid us for the service in the twelve months immediately preceding the event giving rise to the claim, or (b) one hundred United States dollars (US$100).

12. Indemnification

You agree to indemnify and hold harmless Got It Tap and its owners, employees, and contractors from any claim, demand, or expense (including reasonable attorneys’ fees) arising out of (a) the content you publish, (b) your violation of these Terms, or (c) your violation of any law or the rights of a third party.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law provisions. Any dispute arising out of or related to these Terms or the service must be resolved exclusively in the state or federal courts located in Galveston County, Texas, and you and we consent to the personal jurisdiction of those courts.

14. Changes to These Terms

We may update these Terms from time to time. If we make a material change, we will update the “Effective date” at the top of this page and, where appropriate, notify you by email or in-app notice. Your continued use of the service after an update constitutes acceptance of the updated Terms.
